29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) Open trench East of Acoustic Specialties Job Trailer: On or about June 13, 2012, and times prior thereto, employees were laying pipe in a trench that had spoil material less than 2 feet from the North wall of the trench. Hill and Son Excavating LLC. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.651(j)(2) that was contained in OSHA Inspection #311579106 Citation # 1 Item 1b, issued on January 12, 2009; Final Order date of February 5, 2009 and with respect to the work site at N 3700 E. Marysville, Idaho. Note: Abatement Documentation and Certification are required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Open trench East of Acoustic Specialties Job Trailer: On or about June 13, 2012, and times prior thereto, employees were laying pipe in a trench that was 5 feet in depth, and did not have a protective system in place. Hill and Son Excavating LLC. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.652(a)(1) that was contained in OSHA Inspection #311579106 Citation # 1 Item 3b, issued on January 12, 2009; Final Order date of February 5, 2009 and with respect to the work site at N 3700 E. Marysville, Idaho. Note: Abatement Certification and supporting Documentation are required for this item.
