29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: At the project site on or about June 27, 2012, and at times prior thereto, an unauthorized part, such as rebar was used in lieu of an OEM part on the John Deere Loader, Model Number 410G, License Number 699 SEQ. The rebar was used to to secure the rear bucket pin in place.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) At Naval Base Guam, Lockwood Housing, 2251 Safford Rd., on June 27, 2012, and at times prior thereto, material safety data sheets were not readily available for hazardous materials such as, but not limited to Sikaflex 1c SL self leveling sealant.
