29 CFR 1926.652(a)(1):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of his section:    Employees worked in a trench installing new water pipe where the east face of the trench measured between 5 feet 9 inches to 7 feet 3 inches and was without a protective system to prevent soil cave-in.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, shall be determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart:    Employees worked in a trench installing new water pipe where the west face of the trench was benched at 47 inches from the bottom of the excavation with the first horizontal bench measuring 2 feet.  The configuration of the west face did not maintain the required 1:1 slope, exposing employees to a soil cave-in.
