29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: (a) The spoil pile on the south side of the trench was setting on an unshored vertical wall of the trench and at the edge of the trench where it posed a hazard of rolling or falling into the trench. (b) The spoil pile on the north side of the trench was setting on an unshored vertical wall of the trench and at the edge of the trench where it posed a hazard of rolling or falling into the trench.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) The competent person did not take action to prevent spoil from rolling or falling into the trenh, when he observed that the spoil was not back at least 2 feet from the edge. (b) The competent person did not take action to prevent workers from entering a trench when the spoil pile was observed resting on the ushored wall of the tench and was in danger of falling into the trench or causing a trench collapse. (c) The competent person did not take action to prevent workers from entering a trench where the walls of the trench had not been sloped or otherwise protected from trench collapse.
