29 CFR 1926.1412(e)(1): 29 CFR 1926.1412(e)(1): The equipment in service was not inspected each month in accordance with paragraph (d) of this section (each shift). On or about June 25, 2012 a Terex HC 110 crawler crane, S/N AC3801 was used to lift approximately 10 times to lift a 2- yard bucket of concrete and/or stone without being inspected each month in accordance with paragraph (d) of this section (each shift). This exposed the operator and employees working in the near vicinity to injury should a recognizeable malfunction occur creating failures such as but not limited to boom and structural collapse, brake, or wire rope failure which could cause a loss of the load and or the crane to overturn.
