29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. a) Residential Home roof - On or about 28 June, 2012 - Employees were installing and removing asphalt roofing shingles on a 7 on 12 pitch roof without utilizing proper fall protection. Employees were exposed to a fall hazard of approximately 10 feet.

29 CFR 1926.503(c)(3): When the employer has reason to believe that any affected employee who had already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer did not retrain each such employee. Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. a) Residential Home Roof - On or about 28 June, 2012 - Employees were installing and removing asphalt shingles on a 7:12 pitch roof while wearing a rope tied around their waist instead of wearing proper fall protection harnesses. Employees were exposed to a fall hazard of approximately 10 feet. ALEX BROTHERS CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILIAR STANDARD, 1926.503(c)(3), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311978571 CITATION NUMBER 01, ITEM NUMBER 001, ISSUED ON 07/06/2009, FINAL ORDER DATE 07/16/2009, WITH RESPECT TO A WORKSITE LOCATED AT WILTON-GANSEVOORT ROAD, GANSEVOORT, NY 12831
