29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) in a safe and timely manner when necessary means where taken to assure safe operation:    402 Commerce Street, York, NE 68467 (Site-Wide): The employer did not change out 22 pressure relief valves (PRVs) on 5-year intervals as required. These include; but are not limited to;     1) LSC - 1 Pressure relief valve 80.    A recognized and generally accepted good engineering practice from the IIAR (International Institute of Ammonia Refrigeration) Bulletin 110, Section 6.6.3 Revised states that pressure relief devices shall be replaced or recertified in accordance with one of these three options:    1. Every five (5) years from the date of installation. IIAR originally recommended (in 1978) that pressure relief valves be replaced every five years from the date of installation. This recommendation represents good engineering practice considering the design and performance of pressure relief devices; or  2. An alternative to the prescriptive replacement interval, i.e., five years, can be developed based on documented in-service relief valve life for specific applications using industry accepted good practices of relief valve evaluation; or   3. The manufacturers recommendations on replacement frequency of pressure relief devices shall be followed.        Abatement certification and abatement documentation is required for this violation. The abatement certification sheet is enclosed.

29 CFR 1910.134(e)(1):  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:  	                                                       402 Commerce Street, York, NE 68467 (Site-Wide): The employer did not provide medical evaluations prior to requiring employees to use full-face respirators in the workplace.     Abatement certification is required for this violation.  The abatement certification sheet is enclosed with these citations.

29 CFR 1910.134(f)(1):  The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  	                                                       402 Commerce Street, York, NE 68467 (): Employees were required to use full-face respirators to turn off an ammonia valve prior to the employer ensuring they passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT).     Abatement certification is required for this violation.  The abatement certification sheet is enclosed with these citations.
