OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees      On or about June 7, 2012, at a worksite near Richview, Illinois, while the employer was using the JCB backhoe, an employee on the ground was in the hazard work zone near the bucket.  The tractor shifted and an employee was struck by the bucket.        Among other methods, feasible abatement methods include to train employees regarding the hazards of being near the operating equipment, and to prevent employees from being in the work zone next to the backhoe bucket by following the Association of Equipment Manufacturers instructions and warnings.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      A written Hazard Communications program regarding hazardous chemicals had not been developed to inform, protect and train employees on the chemicals hazards.  Employees worked with hazardous chemicals such as but not limited to corrosive inhibitors, automotive oils, brake fluid, and hydraulic oil were exposed to the hazards associated with those products.

29 CFR 1910.1200(g)(1):     The employer did not have a material safety data sheet for each hazardous chemical in use:      Material safety data sheets were not kept that would provide information in case of a medical emergency or condition if an employee ingested or contacted chemicals.  Employees worked with hazardous chemicals such as but not limited to corrosive inhibitors, automotive oils, brake fluid, and hydraulic oil were exposed to the hazards associated with those products.

29 CFR 1910.1200(h)(1):     The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:    Employees had not been trained regarding the hazards related with using hazardous chemicals such as but not limited to corrosive inhibitors, automotive oils, brake fluid, and hydraulic oil were exposed to the hazards associated with those products.
