29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a. On or about 06/28/2012, at the job site - the use of fall protection was not enforced for an employee operating an aerial lift to install stud clips, in that, the harness was not attached to an anchor point, exposing the employee to a 23' fall hazard.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or about 06/28/2012, at the job site - employees installing metal framing from a low slope roof to an existing building were not required to use fall protection, only one of the employees was wearing personal fall protection, but had both ends of the lanyard attached to the harness, exposing the employees to a 15'5" fall hazard.
