29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket.    (a) Rail-tie treatment facility: On or about June 27, 2012; the employer allowed his employees to be exposed to fall hazards in that employees were allowed to climb the rails of the Genie S-45 extending boom lift while transferring to the roof of the building 32 feet above the ground.

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer were exceeded:    (a) Rail-tie treatment facility: On or about June 27, 2012; the employer allowed his employees to be exposed to fall hazards in that employees exceeded to maximum number of occupants allowed in the Genie S-45 extending boom lift while working from the lift 32 feet above the ground. The lift is designed and rated for 2 occupants and the employer allowed 3 employees to work from the lift where there were only 2 tie-off points for the occupants.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    (a) Rail-tie treatment facility: On or about June 27, 2012; the employer exposed his employees to a 32 foot fall hazard while working on the roof of the building installing flashing on the edge of the roof without fall protection.
