29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces: a) Wash bay, employees received verbal training that they were not to enter truck tanks with their bodies during the cleaning. The company written Safety Rules Agreement contradicted this direction by stating that full body entry into tanks was acceptable and required a PVC suit, safety harness and respiratory protection. Employees stated that they commonly reached into the tanks with their hands to wash with spray wands. No effective means of preventing entry into confined spaces was implemented, June 26, 2012. "ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED" b) Outside yard, two manholes which lead to sewage pumps and equipment were not locked in a closed position or clearly labeled with warnings that conveyed that no entry was permitted, June 26, 2012 "ABATEMENT OBSERVED DURING INSPECTION - NO CERTIFICATION REQUIRED"
