29 CFR 1926.1417(o)(1):  The equipment was operated in excess of its rated capacity.    The employer does not ensure that equipment is not operatored in excess of its rated capacity.  This violation was observed on or about June 28, 2012 at a Garden Ridge Construction Site where a 100-Ton Link Belt Crane FMC HC218A overturned when lifting and moving a 68,000 pound concrete tilt wall which was in excess of the load chart requirements.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that operators do not operate cranes in excess of its load chart capacity.
