29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Willoway Nurseries, Inc. - Huron, Ohio: On or about July 2, 2012, the employer did not develop and implement an energy control program that consisted of machine specific lockout procedures, authorized employee training, and periodic inspections before employees serviced the Demaitere 3016 potting machine. Employees were exposed to the unexpected startup of the machines rotating part and pinch-points while setting-up and changing the drilling/auger component. The equipment was not isolated from the energy source(s) before the servicing activity. amended to read: Amended to 1928.57(c)(5)(i)(A) and to read: Application of electrical power from a location not under the immediate and exclusive control of the employee or employees maintaining or servicing equipment was not prevented by providing an exclusive, positive locking means on the main switch which can be operated only by the employee or employees performing the maintenance or servicing: a) Willoway Nurseries, Inc. Huron, Ohio: On or about July 2, 2012, the employer did not develop and implement positive locking means before employees serviced the Demaitere 3016 potting machine. Employees were exposed to the unexpected startup of the machines rotating part and pinch-points while setting-up and changing the drilling/auger component. The equipment was not isolated from the energy source(s) before the servicing activity. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

The employer did not assure the drilling/auger mechanism on the Demaitere 3016 machine was guarded. Amended to 1928.57(c)(4)(i) and to read: Guards, shields, and access doors were not in place when the equipment was in operation: a) Willoway Nurseries, Inc. Huron, Ohio: On or about July 2, 2012, employees working at the canning line were exposed to rotating parts and pinch points. Employees working in the cutting/sticking area were exposed laceration hazards when handling plants with thorns. Employees were required to purchase and provide themselves with gloves when working with rose and barberry plants. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
