29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about June 14, 2012, employer did not ensure that the operator of the JLG Lull, all-terrain forklift was competent and trained to operate the powered industrial truck to lower employees from the roof of the swimming pool pump house being built, exposing the employees to the hazard of a 10 foot fall.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  On or about June 14, 2012, two employees were working on the roof of the pump house without hard hats. One employee came off the roof while the other employee was still working above him installing the roof decking, exposing employees to the hazard of being struck by tools or materials.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected by protective helmets while working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.

29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  On or about June 13, 2012, two employees were standing on a piece of 3/4 inch plywood on the forks tines of a JLG Lull, all-terrain forklift while being lowered down from the roof. The scaffold was not designed by a qualified person and was not loaded in accordance with that design, exposing employees to a fall hazard of approximately 10 feet.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each scaffold will be designed by a qualified person and will be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  On or about June 13, 2012, employees were standing on a 3/4 inch plywood, temporary elevated work platform, (scaffold) which was not attached to the forks of a JLG Lull, all-terrain forklift. The forklift was moving horizontally when bringing employees off the roof of the building, exposing employees to the hazard of a fall of approximately 10 feet in height.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that forklift will not be used to support scaffold platforms, unless the entire platform is attached to the fork of the forklift and is not moved horizontally while the platform is occupied.

On or about June 12, 2012, employees were installing the roof decking of the swimming pool pump house and were not provided with any means of fall protection, exposing employees to the a fall hazard of approximately 10 feet in height.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are protected by guardrail systems, safety net system, or personal fall arrest system, or provide employee(s) with an alternative fall protection measure under another provision of paragraph (b).
