29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set: a) SkyJack all-terrain forklift used on the west side of the residential structure: On or about October 4, 2012, the forklift was left unattended on the level ground (sand) with the load elevated 30-feet, engine running, controls neutralized, and brake on which exposed employee(s) to forklift related hazards such as but not limited to struck by, crushed by, and falls.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and/or the fork-lift was moved horizontally while the platform was occupied: a) Job made platform supported by a SkyJack all-terrain forklift on the west side of the residential structure: On or about October 4, 2012, the employer did not ensure that the attachment used to elevate personnel was attached to the forklift which exposed an employee to a fall of 30-feet to the ground below.
