29 CFR 1926.62(d)(2)(i):  Until the employer performed an employee exposure assessment as required in paragraph (d) of this section and documented that the employee performing any of the listed tasks was not exposed above the PEL, the employer did not treat the employee as if the employee were exposed above the PEL, and not in excess of ten (10) times the PEL, and did not implement employee protective measures prescribed in paragraph (d)(2)(v) of this section:    Engineering Design Technologies, Inc. - on or about June 6, 2012, employees cut/drilled through walls covered with lead-based paint.  The employer had not performed an exposure assessment and employees did not use protective equipment, including respiratory protection.  Four paint samples were collected from walls that employees had drilled/cut through.  Laboratory analysis indicated that lead was present in three of these samples, at 0.07%, 0.091%, and 0.035%.

29 CFR 1926.62(l)(1)(i):  The employer did not communicate information concerning lead hazards according to the requirements of OSHA's Hazard Communication Standard for the construction industry, 29 CFR 1926.59, including but not limited to the requirements concerning warning signs and labels, material safety datasheets (MSDS), and employee information and training:    Engineering Design Technologies, Inc. on or about June 6, 2012, employees drilled/cut through walls covered with lead-based paint.  Employees had not been trained on lead, its hazards, and appropriate protective measures.  Four samples of paint were collected to determine lead content.  Laboratory analysis indicated that lead was present in three, at 0.07%, 0.091%, and 0.035%.

29 CFR 1926.1101(f)(1)(i):  Where exposure monitoring was required under 29 CFR 1926.1101, the employer did not perform monitoring to determine accurately the airborne concentrations of asbestos to which employees were or potentially were exposed:    Engineering Design Technologies, Inc. - on or about June 6, 2012, employees drilled/cut through walls covered with a presumed asbestos containing material (adhesive mastic).  Monitoring had not been performed to determine the employees' exposure and appropriate protective measures.

29 CFR 1926.1101(k)(3)(i):  Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1):    Engineering Design Technologies, Inc. - on or about June 6, 2012, employees performed Class III asbestos work (disturbance of ACM by drilling/cutting).  The employer had not identified the presence, location, and quantity of ACM/PACM in the work area.  PACM (mastic) was present on walls which the employees drilled/cut through.
