OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near dust collection system which were not adequately designed to prevent or minimize employee exposure in the event of a deflagraion or other uncontrolled fire event:    a) End of the Bar line - On or about June 27, 2012, employees were exposed to combustible dust fires and explosion hazards because the inside Torit dust collector system was not provided with adequate deflagration venting and suppression system to prevent and control fires and explosion hazards. The discharge chute was not grounded and bonded to the receiving trash container. The lab results from SLTC confirmed that the dust sample was a Class II dust and was explosive. The Hartmann test gave a Kst value which also determined the sample to be explosive.    b) Main outside dust collector system and ducts - On or about June 27, 2012, employees were exposed to combustible dust fires and explosion hazards because the outside dust collector system and inside ducts were not provided with adequate deflagration control, suppression systems, and isolation devices to prevent and control fires and explosion hazards. The discharge chute was not grounded and bonded to the receiving trash container. The lab results from SLTC confirmed that the dust sample was a Class II dust and was explosive. The Hartmann test gave a Kst value which also determined the sample to be explosive.

29 CFR 1910.22(a)(1):     All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.    a) Trim saw at the end of the Bar line - On or about June 27, 2012, employees were exposed to combustible dust fires because the dust collector had a build-up of dust on the metal frame and electrical boxes nearby. The wood dust on the floor around and under the trim saw was not being collected by the dust collector.    b) Outside dust collector system - On or about June 27, 2012, employees were exposed to combustible dust fires because the dust under the dust collector and trash dumpster had build-up on the ground.
