29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) Apartment front - On or about 3 July, 2012 - Employees were an extension ladder to access the left side of the roof that did not have the side rails extended a minimum of 3 feet above the landing (extension was approximately 2 feet). Employees were exposed to a fall hazard of approximately 21 feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    a) Roof of apartment building - On or about 3 July, 2012 -  Employees were installing new asphalt roofing shingles on A 5 in 12 pitch roof without use of fall protection.  Employees were exposed to a fall hazard of approximately 21 feet.     DOUGLAS-ALEXANDER CONSTRUCTION, INC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATION SAFETY AND HEALTH STANDARD, 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NO. 315751859, ISSUED ON 3/8/12, FINAL ORDER DATE 3/24/12, WITH RESPECT TO A WORKSITE LOCATED AT 84 WINDSOR HIGHWAY, NEW WINDSOR, NY 12553.
