1926.1101(k)(3)(ii)(B) Before work under this standard was performed employers failed to inform employees who performed such and employers of employees who work and/or will be working in adjacent areas of the location and quantity of ACM and/or PACM present in the area and the precautions to be taken to insure that airborne asbestos was confined to the area: a. Philadelphia Museum of Art, Basement Level B, Section 1, Art Storage - The employer did not notify subcontractor employees of information concerning the specific presence, location, and quantity of previously installed asbestos-containing material (ACM) or presumed asbestos-containing material (PACM) in or adjacent to their work area. Two subcontractor employees were directed by the employer to work on an overhead duct in the ceiling. The employers bulk sampling of damaged duct insulation detected approximately 35 % chrysotile asbestos. The inhalation of asbestos fibers can cause asbestosis and lung cancer. Observed On or About June 28, 2012 b. Philadelphia Museum of Art, Basement Level B, Section 2, Across from the Elevator - The employer did not notify subcontractor employees of information concerning the specific presence, location, and quantity of previously installed asbestos-containing material (ACM) or presumed asbestos-containing material (PACM) in or adjacent to their work area. Philadelphia Museum of Art, Basement Level B, Section 1, Art Storage - The employer failed to ensure that a warning label that specifically warned about the presence of asbestos was affixed near asbestos-containing material (ACM). Two subcontractor employees were directed by the employer to work on an overhead duct in the ceiling. The employers bulk sampling of damaged duct insulation detected approximately 35 % chrysotile asbestos. The inhalation of asbestos fibers can cause asbestosis and lung cancer. 1926.1101(k)(9)(i) The employer did not train each employee who is likely to be exposed in excess of a PEL, and each employee who performs Class I through IV asbestos operations, in accordance with the requirements of this section. Such training shall be conducted at no cost to the employee. The employer shall institute a training program and ensure employee participation in the program: a. Philadelphia Museum of Art, Basement Level B, Section 1, Art Storage - The employer failed to ensure that subcontractor employees, who performed activities where asbestos-containing material (ACM) was likely to be disturbed, were given the appropriate asbestos related training. Two employees were directed by the employer to cut an overhead duct flush with the ceiling above. The employers bulk sampling of damaged duct insulation detected approximately 35 % chrysotile asbestos. The inhalation of asbestos fibers can cause asbestosis and lung cancer. Observed On or About June 28, 2012 b.
