29 CFR 1926.502(b)(1): Top edge height of top rails, or equivalent guardrail system members, shall be 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level. When conditions warrant, the height of the top edge may exceed the 45-inch height, provided the guardrail system meets all other criteria of this paragraph. a) East lane of bridge deck: On June 25, 2012 and at times prior thereto employees performed bridge deck repair and rehabilitation activities without a fall protection system in place. These activities included, but were not limited to, removing the railing and breaking up the concrete deck, 15 to 25 feet above the ground and active highway below. A single wire cable that was in place ranged from 38 inches high at the stanchions to as low as 24 inches in between the stanchions. Employees were not attached to the wire cable as a means of fall protection. The wire cable did not meet the minimum requirements of a guardrail system or the horizontal lifeline component of a personal fall arrest system.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes by covers: a) East side lane of bridge deck: On June 25, 2012 and at times prior thereto employees performing bridge deck repair and rehabilitation activities were exposed multiple tripping hazards on the bridge deck working area where the existing concrete had been removed from around rebar leaving holes that ranged from 14" to 16" wide. Note) Abatement certification IS required for this item.
