29 CFR 1910.23(c)(1):  Every open sided floor, platform or runway 4 or more feet above adjacent floor or ground level was not guarded with a standard guardrail or the equivalent on all open sides to protect employees from fall hazard:    Location: 601 W 122 Street, New York, N.Y.     On or about 5/10/2012     a)  Employees were exposed to falling 27 ft from the roof when using stepladders to install a tent on a rooftop patio.  The 6 ft stepladder employees were using was unstable and employees climbed high up on the ladder to where they can fall over the roof railing.      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.25(d)(1)(i):  Ladders were not maintained in a good condition at all times; with moveable parts not having undue play:    Location: 601 W 122 Street, New York, N.Y.     On or about 5/10/2012     a)   The 6 foot A-frame stepladder used by employees had excessive wear causing it to be unstable. The ladder had worn spreaders, was overly flexible, warning labels were worn off.  Employees were exposed to fall hazards when using the ladder during installation of tent on a rooftop patio.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.25(d)(2)(xii):  Tops of ordinary types of stepladders were used as steps:     Location: 601 W 122 Street, New York, N.Y.     On or about 5/10/2012    a)  Employees stood on the upper steps of a 6 ft stepladder, causing the ladder to be unstable. Employee was exposed to falling 27 ft off the roof when the ladder became unstable and tipped over.  To get extra height the employee straddled the top of the ladder with one foot on the upper steps (2nd from top step) and the other foot on the bracing on the back of the ladder. Warning labels on the ladder prohibit standing on these upper steps but the labels were worn off.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

On or about 5/10/2012     a)         Employees straddled the top of the ladder with one foot on the upper steps (2nd from top step) and the other foot on the bracing on the back of the ladder.  The ladder kicked out and the employee fell.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

On or about 5/10/2012     a)         Employees were exposed to electric shock hazard when installing and using temporary light cables onto the frame of a rental tent.  Wire insulation was worn and separated in several instances, exposing the inner wires to damage.
