29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): (a) Facility Wide - An employee operates a Yale fork lift to move pallets that had two non-functioning lights. The employer did not remove the fork lift from service when it was found to be in need of repair, on or about July 6, 2012. (b) Facility Wide - An employee operated a jockey truck. The employer did not remove the truck from service when it was found to have defective lighting and a defective fuel switch, on or about July 6, 2012. IFCO SYSTEMS NORTH AMERICA INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION STANDARD OR IT'S EQUIVALENT STANDARD 29 CFR 1910.178(p)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311334502, CITATION NUMBER 1, ITEM NUMBER 7, AND WAS AFFIRMED AS A FINAL ORDER ON 3/19/2008, WITH RESPECT TO A WORKPLACE LOCATED AT 1919 TROPHY DRIVE, MCALLEN TEXAS 78504. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
