29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. At the site located at 3705 East Lucas in Beaumont, TX. two employees were observed working on the third tier of a scaffold applaying stucco. The employees were not protected against falls by the use of a personal fall arrest system or an adequate guardrail system. This condition exposed the employees to fall hazards of appoximately 18'.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): At the site located at 3705 East Lucas in Beaumont, TX an employee of Raul Salmeron Constuction was observed operating a telescopic forklift. The employee was not certified to operate the piece of equipment. This condition exposedthe employee to struck by hazards.
