29 CFR 1910.1028(e)(1)(ii): Representative 8-hour TWA employee exposures were not determined on the basis of one sample or samples representing the full shift exposure for each job classification in each work area: a) Lewis Environmental (Sunoco - Marcus Hook): Employees (Drivers and Technicians) opened frac tanks and transferred products such as water into and out of the tanks. The water contained residual amounts of oil which contained benzene. Two employees reported exposure to benzene during the water transfer process on two separate occasions. The employer did not determine the eight hour time weighted average exposures for employees conducting the task. On or about June 19, 2012.

29 CFR 1910.1028(e)(2)(i): The employer did not monitor each workplace and work operation to determine accurately the airborne concentrations of benzene to which employees may be exposed: a) Lewis Environmental (Sunoco - Marcus Hook): Employees (Drivers and Technicians) opened frac tanks and transferred products such as water into and out of the tanks. The water contained residual amounts of oil which contained benzene. Two employees reported exposure to benzene during the water transfer process on two separate occasions. The employer did not monitor the work operation to accurately determine the concentration of benzene to which the employees may have been exposed. On or about June 19, 2012.
