29 CFR 1910.178(l)(5):  Where an operator had previously received training in a topic specified in paragraph (l)(3) of this section, and such training was appropriate to the truck and working conditions encountered, additional training in that topic is not required if the operator has been evaluated and found competent to operate the truck safely.    The employer did not ensure that employees driving the Hyster 540F forklift were competent to operate the lift.

29 CFR 1910.178(q)(7):  Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily.  Defects when found shall be immediately reported and corrected.    A forklift located in the facility was missing a seat belt, indicating that the forklift had not been inspected to determine that the forklift was in a safe condition before allowing employees to use.

29 CFR 1910.215(b)(9):  The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:    The bench grinder in the non-ferrous metal area had an opening of approximately 1/2 inch between the tongue guard and the abrasive wheel. The employees were exposed to being struck by exploding and/or flying fragments of the wheel.
