OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to physical struck by hazards from a Bob cat skid steer, Model S300, company #4 and Bob cat skid steer, Model S300 SN 525813666 that was operating in the warehouse and the yard area without a functioning back up alarm.      a)  Outside yard:  On or about August 1, 2012, and prior to, the employer exposed employees to struck-by hazards, in that the Bobcat skid steer, SN 525813666 did not have a working back up alarm while moving scrap aluminum.     b)  Inside shop:  On or about August 1, 2012, and prior to, the employer exposed employees to struck by hazards, in that the Bobcat skid steer, company #4 did not have a working back up alarm while moving scrap aluminum.

29 CFR 1910.95(c)(1):     The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  Inside Bobcat Operator:   On or about August 2, 2012 an employee was exposed to noise dose at levels of 144.85 % (equivalent to an 8 hour time weighted average TWA of 92.673 dBA) which is 2.89 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating a diesel fueled 5300 Bobcat, company equipment #4 around the Excel baler. Results were calculated for a 388 minute sampling period.    b)  Outside Bobcat Operator:   On or about September 6, 2012 an employee was exposed to noise dose at levels of 128.97 % (equivalent to an 8 hour time weighted average TWA of 91.83 dBA) which is 2.58 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating a diesel fueled 5300 Bobcat, ID Number 515845007 around the Nexgen baler. Results were calculated for a 307 minute sampling period.

29 CFR 1910.95(l)(1):     The employer did not make available to affected employees or their representatives copies of 29 CFR 1910.95 and did not post a copy in the workplace:        a)  Bobcat Operator:   On or about August 2, 2011 an employee was exposed to noise dose at levels of 144.85 % (equivalent to an 8 hour time weighted average TWA of 92.673 dBA) which is 2.89 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating a diesel fueled 5300 Bobcat, company equipment #4 around the Excel baler. Results were calculated for a 388 minute sampling period and a copy of the standard was not provided and posted in the work place.

29 CFR 1910.134(k)(6):     The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:    a)Yard and Shop Area:  On or about August 02, 2012, and prior to, employees were exposed to inhalation hazards from dust in the yard and shop area while cleaning and unloading scrap nonferrous metal from trailers to be recycled.  The employee(s) had not been provided training on Appendix D and were provided and wear dust mask respirators.
