29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l), as referenced by the note contained in 1926.602(d):    a)  A & J Construction at 5410 Wishing Well Lane, Timnath, CO 80547:  On or before July 7, 2012, the employer did not ensure that the operator of the 534 C Gradall rough terrain forklift was trained and certified to operate this forklift.  Condition exposed employees to the electrical shock hazards.

29 CFR 1926.404(f)(6):  The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a)  A & J Construction at 5410 Wishing Well Lane, Timnath, CO 80547:  On or before July 7, 2012, the employer provided a portable 4-plex metal outlet box mounted on a wood stud, that was connected to a temporary power panel by a flexible extension cord, and this box was not properly grounded.  The panel was used to power 120 volt portable electric tools including a Dewalt Sawzall model DW304P and a Skilsaw.  Condition exposed employees to electrical shock hazards.

29 CFR 1926.502(b)(1):  The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches plus or minus 3 inches above the walking/working level:    a)  A & J Construction at 5410 Wishing Well Lane, Timnath, CO 80547:  On or before July 7, 2012, the employer did not ensure that the top edge of the top rails was 42" +/- 3" in the following instances:    1)  The window wall openings were 36" high measured from the floor to the lower ledge; and     2)  The guardrails around the stairway opening on the second floor were 36" measured from the floor to the top edge of the top rail.    Conditions exposed employees to fall hazards of up to 10'.

29 CFR 1926.1052(c)(1):  Stairways having four or more risers or rising more than 30 inches, whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:    a)  A & J Construction at 5410 Wishing Well Lane, Timnath, CO 80547:  On or before July 7, 2012, the employer provided access to the downstairs steps without providing a stairrail and handrail.  The stairs included a set of 7 steps dropping to a landing, and from there, another set of 7 steps dropping to the basement.  Each step had a 7.5" rise over an 11 1/4" run, and the steps were 41" wide.  Open studded walls served as the perimeter for the steps, with the studs 24" on-center.  Condition exposed employees to fall hazards of up to 5'2".
