29 CFR 1926.451(b)(1)(i):     Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  a) On or about 07/02/12, on construction site at 8210 Main St., Williamsville, NY: Two employees doing painting work while working from the top level of a mobile fabricated frame scaffold were exposed to a fall of approx. 10 ft. 11 in. because the level was not fully planked. The width of the scaffold was 60 inches, and there were only three approx. 12 in. wide wood planks in place instead of the five required.      b) On or about 07/02/12, on construction site at 8210 Main St., Williamsville, NY: One employee doing painting work while working from the middle level of a mobile fabricated frame scaffold was exposed to a fall of approx. 8 ft. 5 in. because the level was not fully planked. The width of the scaffold was 60 inches, and there was only one approx. 12 in. wide wood plank in place instead of the five required.    c) On or about 07/02/12, on construction site at 8210 Main St., Williamsville, NY: One employee doing painting work while working from the lower level of a mobile fabricated frame scaffold was exposed to a fall of approx. 6 ft. 6 in. because the level was not fully planked. The width of the scaffold was 60 inches, and there was only one approx. 12 in. wide wood plank in place instead of the five required.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.      a) On or about 07/02/12, on construction site at 8210 Main St., Williamsville, NY: Employees were exposed to potential fall of up to 10 ft. 11 in. while accessing the top level of a mobile fabricated frame scaffold by climbing the end frame of the scaffold. 29 CFR 1926.454(a)(1):    The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  The training shall include the nature of any electrical hazards, fall hazards, and falling object hazards in the work area:      a) On or about 07/02/12, on construction site at 8210 Main St., Williamsville, NY: Two employees doing painting work while working from the top level of a mobile fabricated frame scaffold were exposed to a fall of approx. 10 ft. 11 inches. The employees were not trained about the nature of fall hazards associated with working from this type of scaffold, the pertinent OSHA scaffolding regulations, and the procedures to control or minimize those hazards.    ABATEMENT CERTIFICATION REQUIRED
