29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b)    a)  At the residential construction site, on the front porch roof:  On Jul 9, 2012 the employer did not ensure employees loading bricks onto the front porch roof by catching them near the roof edge by hand when thrown from below were protected from a fall hazard of approximately 9.5 feet by a guardrail system, safety net system, personal fall arrest system, or an alternative fall protection measure under another provision of paragraph (b).

29 CFR 1910.1200(h)(3)(iii):  Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (Construction Reference: 1926.59)    a)  At the residential construction site:  On Jul 9, 2012 the employer did not ensure employees were trained in measures to protect themselves from chemical hazards or the appropriate work practices listed on the material safety data sheet for ACME bricks being dry cut on the site.  The material safety data sheet specifies that wet sawing methods is recommended anytime bricks must be cut due to chronic effects including but not limited to irreversible lung disease, silicosis, tuberculosis or lung cancer.
