29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    On or about July 10, 2012 and times prior thereto, an employee of KMF, Inc. was required to wear a tight fitted half-face air purifying respirator when performing spray painting operations in the paint shop located at or near 5730 N. 6th Street in Fort Smith, Arkansas.  The employer had not provided the employee with a medical evaluation to determine if the employee was medically qualified.    Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

29 CFR 1910.134(f)(1):     The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):    On or about July 10, 2012 and times prior thereto, an employee of KMF, Inc. was required to wear a tight fitted half-face air purifying respirator with organic cartridges when performing spray painting operations in the paint shop located at or near 5730 N. 6th Street in Fort Smith, Arkansas.  The employer did not ensure that the employee passed a qualitative fit test (QLFT) or a quantitative fit test (QNFT) before use.

29 CFR 1910.134(g)(1)(i)(A):     Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:    On or about July 10, 2012 and times prior thereto, an employee of KMF, Inc. was required by the employer to wear a tight fitted half-face air purifying respirator with organic filter cartridges when performing spray painting operations in the paint shop at or near 5730 N. 6th Street in Fort Smith, Arkansas.  The employee performing the spray painting was observed with facial hair which impeded the proper seal and use of the respirator.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On or about July 10, 2012 and times prior thereto, employees of KMF, Inc. performed metal fabrication at 5730 N. 6th Street in Fort Smith, Arkansas.  One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    Employees operated machinery which was not guarded to protect the employees from point of operation hazards.  Unguarded machinery is as follows:    a.  A drill press (no known manufacturer) was observed in the job shop location without guarding at the point of operation, exposing employees to rotating parts.    b.  A band saw manufactured by Wells with a model number of 58B and a serial number of 4174 did not have a guard for the unused portion of the blade, exposing employees to amputation hazards.    c.  A two roll-bending machine manufactured by San Angelo Foundry and Machine Company with a model number of 3300 was observed in the job shop bay without guarding at the point of operation, exposing employees to ingoing nip points.    d.  Employees operated a lathe manufactured by Webb in the job shop bay to polish tubing.  The lathe did not have a chuck guard installed at the point of operation, exposing employees to flying debris.    e.  A three roll-bending machine manufactured by Webb with model number 9L-1210 and serial number 6759 was observed unguarded at the point of operation in the job shop bay, exposing employees to an ingoing nip point.    f.  A two roll-bending machine (no known manufacture) was observed in the job shop bay and was unguarded at the point of operation, exposing employees to an ingoing nip point.    g.  A drill press manufactured by Houdaille Industries, Inc. with model number 1150 and serial number 915V734 was observed in the job shop location.  The drill press was not guarded at the point of operation, exposing employees to rotating parts.

The mechanical power press brakes used by employees were observed unguarded in the following instances:    a) A Conagra mechanical power press brake was observed in the job shop area.  The press brake measured 8 feet in length and was operated by the use of a guarded foot pedal.  The press brake was not guarded at the point of operation, exposing employees to amputation hazards.    b) A Steelweld mechanica power press brake with a model number of K5-10 and serial number M4680 was observed in the job shop area.  The press brake measured 12 feet in length and was operated by the use of a guarded foot pedal.  The press brake was not guarded at the point of operation, exposing employees to amputation hazards.    c) A Chicago mechanical power press brake was observed in the job shop area.  The press brake measured 12 feet in length and was operated by the use of a guarded foot pedal.  The press brake was not guarded at the point of operation, exposing employees to amputation hazards.    d) A GMS mechanical power press brake was observed in the job shop area.  The press brake was operated by the use of a guarded foot pedal.  The press brake was not guarded at the point of operation, exposing employees to amputation hazards.

29 CFR 1910.305(g)(2)(iii):     Flexible cords and cables were not connected to devices and fittings so that strain relief was provided that would prevent pull from being directly transmitted to joints or terminal screws:    On or about July 10, 2012 and times prior thereto, employees of KMF, Inc. fabricated metal components for Baldor Electric Company in the production area located at 5730 N. 6th Street in Fort Smith, Arkansas.  An industrial fan was located and used near the CNC milling machines.  The bushing was not attached to the metal switch box to provide strain relief and prevent the pull of the flexible cable.
