29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) At the construction site; 11th floor, concrete pour location: The employer did not inspect the work area to ensure floor holes were properly covered before having employees enter to work in the area. Employees were exposed to 15 ft fall hazard at one of the floor holes which was not properly covered. Location: 881 7th Ave, New York, N.Y. On or about 7-3-2012 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(i)(3): All floor hole covers were not secured when installed so as to prevent accidental displacement by wind, equipment, or employees: a) At the 11th floor; concrete pour area: There was a duct opening floor hole measuring 27 inch by 88 inches which had a plywood floor hole cover that was not secured. The cover consisted of two pieces of plywood almost the same size as the metal frame of the floor opening; if the unsecured covers moved or shifted slightly they would collapse and fall into the hole. An employee stepped on the cover and it fell in; the employee fell 15 ft to the 10th floor. Location: 881 7th Ave, New York, N.Y. On or about 7-3-2012 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
