On or about July 6, 2012 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to scaffolding and falls.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a.  On or about July 6, 2012 - at the above addressed jobsite, an employee conducting tuckpointing operations from a tubular welded frame scaffold, approximately seventeen (17) feet above the ground, was not trained to recognize the hazards associated with scaffolding, thereby exposed to the hazards associated with falls.

Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification.    a.  On or about July 06, 2012 - at the above addressed jobsite, employees used a re-locatable power tap, which is meant for household use, to supply power for tools, such as but not limited to a hand operated mortar mixer, thereby exposing employees to the hazards associated with electrical shock.

Hard service flexible cords No. 12 or larger may be repaired if spliced so that the splice retains the insulation, outer sheath properties, and usage characteristics of the cord being spliced.    a.  On or about July 06, 2012 - at the above addressed jobsite, a flexible cord with visible splices was used to supply power to a hand operated mortar mixer, thereby exposing the employees to hazards associated with electrical shock.

On or about July 06, 2012 - at the above addressed jobsite, employees constructed a tubular welded frame scaffold that was not designed by a qualified person, thereby exposing employees to fall hazards.

29 CFR 1926.451(c)(2)(ii): Unstable objects shall not be used to support scaffolds or platform units.    a. On or about July 06, 2012 - at the above addressed jobsite, an employee was performing tuckpointing operations from a tubular welded frame scaffold approximately seventeen (17) feet above the ground.  This scaffold was erected on unstable objects such as aluminum extension ladders and scrap lumber, thereby exposing the employee to a fall.
