29 CFR 1904.29(a): The employer did not use an OSHA 300, 301 and 300A Form or equivalent. On or about July 16, 2012, the employers form used for recording injuries and illnesses, Accident Reporting and Investigation form was not equivalent to an OSHA 301 where the physicians information was missing. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an OSHA 300, 301 and 300A Form or equivalent is used for recording an injury.

29 CFR 1904.29(b)(3): Each recordable injury or illness was not entered on the OSHA 300 Log and/or an accident report (OSHA Form 301 or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness has occurred. On or about July 16, 2012 at the establishment, CSHO ascertained, an employee was injured sustaining an amputation to the right index finger on April 28, 2012 and was not recorded on the OSHA 300 log within 7 days of the injury. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each recordable injury or illness on the OSHA 300 Log and 301 Incident Report is recorded within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the person who certifies the annual summary is a company executive or the highest ranking company official working at the establishment.
