29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. An employee, working between the conveyors of the Big Mill removing rocks from the mulch, was exposed to a noise dose of 87.48%, or and equivalent dBA (decibels "A" scale) of 89.0 dBA, which is capable of causing hearing loss. The sampling was performed for 385 minutes during one shift on July 9, 2012. The employer did not administer a continuing and effective hearing conservation program. b. An employee, working on the Big Mill removing rocks from the mulch, was exposed to a noise dose of 97.71%, or and equivalent dBA of 89.5 dBA, which is capable of causing hearing loss. The sampling was performed for 388 minutes for one shift on July 9, 2012. The employer did not administer a continuing and effective hearing conservation program.
