29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) (a) 456 Hardy Road, Mississippi State University - On or about July 6, 2012 a medical evaluation had not been conducted to assure employees were able to wear the half mask respirator required to be worn while grinding mortar off the brick building it is also known as repointing.
