29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a) Rocky Mountain Roof Doctors at 10455 Dawson Drive, Lafayette, CO 80026: On and before July 12, 2012, the exposing employer did not ensure that employees were protected from injury in that fourteen employees were removing and replacing shingles and gutters on two one-story school buildings without utilizing a fall protection system. Employees conducted activities along the eave, the rake edge and along the peak of the roof. The pitch of the main roof was approximately 6-in-12. This condition exposed the employees to a fall hazard of 8 feet. Abatement Note: Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Rocky Mountain Roof Doctors at 10455 Dawson Drive, Lafayette, CO 80026: On and before July 11, 2012, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment made by a competent person. Approximately 14 workers, including temporary workers, were removing and installing roofing materials on a one-story duplex without using a fall protection system. The pitch of the main roof was approximately 6-in-12. This condition exposed employees to an approximate 8 foot fall hazard.
