Section 5 (a) (1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:      a) On or about 7/12/12 in the Tonawanda Coke overage dump area; an 80,000 pound capacity dump trailer, operated by contract carrier All Pro Transport, was loaded, at the old coke station, to a weight in excess of the legal requirements for over the road travel.   The driver was directed by Tonawanda Coke to a designated area to dump the excess.  After dumping the excess, the trailer was raised again to level the load.  As the trailer was being lowered, a tip over of the trailer and tractor occurred, due to the uneven and soft surfaces in the dump area.        Abatement Documentation
