OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees At the worksite: On or about April 17, 2012, the employer required an employee to operate a water transfer pump without the recirculation (pit valve) line secured or designed to prevent piping displacement. Employee was exposed to struck-by and drowning hazards.

29 CFR 1910.132(d)(1)(i): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). When such hazards were present, or likely to be present, the employer did not: i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; and At the worksite: On or about April 17, 2012, and at times prior thereto, the employer did identify, select and require the use of a personal flotation device for an exposed employee while working around a water retention pond. The employee was exposed to struck-by and drowning hazards.
