Section (5)(a)(1) of the OSH ACT of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of falling:    a) 445 State Street, Perth Amboy, NJ: An employee was exposed to falls of 26 feet to the ground while performing roofing operations . The worker was raised to the roof of the building on a job-made platform (pallet) on the elevated forks of a GENIE all-terrain forklift, which was not secured to the forks/carriage and did not incorporate a guardrail system.  Furthermore, the worker was not otherwise protected by wearing a body harness coupled with a shock absorbing lanyard as a personal fall arrest system.    Condition noted on or about 7/18/2012.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    a) 445 State Street, Perth Amboy, NJ: An employee was exposed to falls of 26 feet to the ground while performing roofing operations .
