OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being ejected or crushed due to the company not providing Roll-Over Protective Structures (ROPS) while the employees were driving the KUBOTA RTV 500 Utility Vehicles and operating KUBOTA Zero Turn Mowers without the use of Roll-Over Protective Structures (ROPS) in the full upright position: a. On or about July 17, 2012, on U.S. Highway 1, employees were operating the KUBOTA RTV 500 Utility Vehicles without the use of Roll-Over Protective Structures, exposing themselves to a possible ejection or crushed hazard. b. On or about July 17, 2012, on U.S. Highway 1, employees were operating the KUBOTA Zero Turn Mowers without the use of Roll-Over Protective Structures (ROPS) in the full upright position, exposing themselves to a possible ejection or crushed hazard.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a. On or about July 17, 2012, on U.S. Highway 1, an employee operating a KUBOTA Tractor was not wearing a seat belt, exposing himself to the hazard of being ejected from the tractor.

29 CFR 1904.39(a): Basic requirement. Within eight (8) hours after the death of any employee from a work-related incident or the in-patient hospitalization of three or more employees as a result of a work-related incident, the employer did not orally report the fatality/multiple hospitalization by telephone or in person to the Area Office of the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, that is nearest to the site of the incident. The employer may also have used the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742): a. On or about July 17, 2012, the employer failed to inform OSHA within 8 hours after the death of one of their employees from a work related accident. The employer was advised of the victim's death at approximately 1:00 pm on July 17, 2012, and OSHA was notified by a third party at 5:00 pm on July 18, 2012.
