29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated      (a)  At the work site on July 19, 2012, an employee was working from an aerial lift, Genie-Model 65,   without wearing a body belt and lanyard attached to the boom or basket, thereby exposing the employee to fall hazards.    (b) At the work site on July 19, 2012, an employee was working from an aerial lift, JLG-Model 40H,   without wearing a body belt and lanyard attached to the boom or basket, thereby exposing the employee to fall hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a)  At the work site on July July 19, 2012, an employee was performing work while on top of a commerical building's roof whose edge was unprotected, without being provided with fall protection. This condition exposed the employee to falls greater than 19 feet above ground level.
