29 CFR 1926.501(b)(6): Each employee on ramps, runways, and other walkways shall be protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems: a) East End of the Foundation Excavation - Concrete workers were observed using a unprotected concrete form as a make shift ramp to enter and exit the excavated site. Employees were exposed to a fall from elevation of up to a maximize height of 6 foot 6 inches.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) Throughout the Foundation Excavation - Concrete workers were observed working approximately 90 feet from the nearest stairway, ladder, ramp or other safe means of egress. This condition exposed employees to unsafe working conditions in the event of a cave-in.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) West End & South Side of the Foundation Excavation - There was no protection provided for concrete workers who were working directly next to and against the face of the unprotected foundation walls. These walls measured approximately seven feet high. This condition exposed employees to unsafe working conditions in the event of a cave-in.
