29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) a) On or about 7/19/12, at the West Seneca Senior High School Construction Site, 3330 Seneca St.,West Seneca, NY: Two employees were removing/installing Anodized Aluminum panels on the outside of the building while working from the top level of a mobile fabricated frame scaffold. The employees were exposed to a fall of 7 ft. because the level was not fully planked. The width of the scaffold between the uprights was 58 inches, and there were only two 18 3/4 inch wide "piks" in place instead of the three required. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(e)(8): Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface: a) On or about 7/19/12, at the West Seneca Senior High School Construction Site, 3330 Seneca St.,West Seneca, NY: Employees climbed the prefabricated end frame of the scaffold for access to the top work level. The scaffold wheels were on the concrete sidewalk and the vertical distance between the concrete surface and the bottom rung of the scaffold frame was 37 inches. No ladder was provided to bridge that gap. NO ABATEMENT CERTIFICATION REQUIRED

The employee was not wearing a body belt/body harness with a lanyard, and was not tethered to the basket in any other way. NO ABATEMENT CERTIFICATION REQUIRED
