29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On or about 7/17/12 at a residential new build located at 4786 Mosey Lane, Orchard Park, New York; employees framing and sheathing a 2 story house were building a dormer and nailing down sheathing on a 6 in 12 pitched roof with an eave height of approximately 17 feet. There were no fall protection measures in place. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: a) On or about 7/17/12 at a residential new build located at 4786 Mosey Lane, Orchard Park, New York; employees framing and sheathing a 2 story house were building a dormer on the front of the building. Employees were using sheets of oriented strand board for a platform supported by the forks of an all-terrain fork lift approximately 16 feet. There were no fall protection measures in place. NO ABATEMENT CERTIFICATION REQUIRED
