29 CFR 1926.453(b)(2)(iv):     Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket:      a) On or about 7/19/12, at front of building located on jobsite at 885 Niagara St., Buffalo, NY: An employee was exposed to potential fall of approx. 35 ft. while doing caulking and mortar repair work from the elevated "basket" of a "JLG Model 660 SJ" aerial lift. The employee was sitting on the top rail of the perimeter guardrail  system of the lift basket with both of his legs outside the basket.         NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(d)(23):     Personal fall arrest systems were attached to guardrail systems or to hoists:      a) On or about 7/19/12, at front of building located on jobsite at 885 Niagara St., Buffalo, NY: An employee was exposed to potential fall of approx. 35 ft. while doing caulking and mortar repair work from the elevated "basket" of a "JLG Model 660 SJ" aerial lift. The employee was sitting on the top rail of the perimeter guardrail  system of the lift basket with both of his legs outside the basket. The employee was wearing a full body harness with a lanyard, but the lanyard was "choked" around the top rail of the perimeter guardrail system. This was not one of the two proper anchor points  provided in the lift basket by the manufacturer for use with a personal fall arrest system.       NO ABATEMENT CERTIFICATION REQUIRED
