29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) At the site where framing work was being done, the employer did not ensure the use of fall protection for employees who were climbing and straddling the top of the trusses, to secure the trusses with hammer and nails, thereby exposing employees to an approximate 20 foot fall hazard. b) At the site where framing work was being done, the employer did not ensure the use of fall protection for employees securing trusses while standing on the outer top plate area, thereby exposing employees to an approximate 10 foot fall hazard.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step. a) At the worksite, the employer did not ensure that employees not use the top step of a six foot step ladder to access/exit upper level, where trusses were being installed, thereby exposing employees to an approximate six to ten foot fall hazard.
