29 CFR 1910.134(c)(1):     In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:      a.  At the work site located at 1250 West 5th Street, Marysville, OH, the employer did not have a written respiratory protection plan.  Employees at the site were required to wear respiratory protection when cutting bricks with an electric saw.

29 CFR 1910.134(g)(1)(i)(A):     The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have:  facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function; or        a.  At the work site located at 1250 West 5th Street, Marysville, Ohio, the employer allowed an employee with a full beard to wear respiratory protection while cutting bricks with an electric saw.  The full beard did not allow a seal between the face and the respirator face piece.

29 CFR 1910.134(k)(1)(i):     The employer shall ensure that each employee can demonstrate knowledge of at least the following:  Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator;    a.  At the work site located at 1250 West 5th Street, Marysville, Ohio, employees who cut bricks with an electric saw were required by the employer to wear respiratory protection.  One employee had a full beard which would prevent a proper seal.  Another employee had worn his respiratory protection on his forehead while cutting bricks.

29 CFR 1904.29(a):     Basic requirement. You must use OSHA 300, 300-A, and 301 forms, or equivalent forms, for recordable injuries and illnesses. The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report.      a.  At the work site located at 1250 West 5th Street, Marysville, OH  43040, the employer did not keep an OSHA 300 Log of Work-Related Injuries and Illnesses for employees for 2012.  An employee at the work site had his left hand fractured when it was struck by bricks at the work site.
