29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) The Residences at Towamencin Town Square - on or about June 8, 2012, employees are conducting finishing and frame carpentry work, at heights between 8 to 30 feet above unfinished grade, without any means of fall protection. b) The Residences at Towamencin Town Square, Roof - on or about June 8, 2012, employees are conducting roofing work from steeply sloped roof fields, no less than 49 feet above unfinished grade, and are also doffing their fall protection equipment then transiting the roof without any means of fall protection.
