29 CFR 1926.602(d) as reference to 29 CFR 1910.178 (l):     An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.    Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 29 CFR 1910.178(l) of this chapter.    a)  Jobsite - On or about and at times prior to July 19, 2012, the employer did not ensure employees who operated powered industrial truck(s) such as, but not limited to, a JCB 506C HL, Telescopic  forklift were evaluated in their performance at least once every three years, thus exposing employees to forklift accidents and struck-by hazards.      ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.451(c)(2)(iv):     Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    a) Jobsite Area A - On or about July 19, 2012, an employee was working from a 4-foot X 4-foot wooden pallet that was supported and elevated by a JCB 506C HL, Telescopic forklift. The forklift manufacture only allows JCB approved attachments to be used with its equipment, thus exposing the employee to struck-by hazard.       ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1926.451(c)(2)(v):     Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.    a)  Jobsite, on or about July 19, 2012, an employee was observed working from an unapproved work platform that was elevated and supported by a JCB Telescopic Handler, Forklift, Model 506C HL.  The unapproved work platform was not secured the forks, thus exposing the employee to ejection, and struck-by hazards.     b)  Jobsite, on or about July 19, 2012, an employee was observed working from an unapproved work platform that was elevated and supported by a JCB Telescopic Handler, Forklift, Model 506C HL.  The unapproved work platform was moved horizontally to reposition the worker, thus exposing the employee to ejection, and struck-by hazards.     ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1926.502(d)(16)(iii):     be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;    a) Jobsite - On or about July 19, 2012, an employee working elevated about 8 feet from the lower surface was wearing personal fall arrest system (PFAS) that consisted of a full body harness and a 6-foot shock absorbing lanyard attached to the forklift carriage, the application would have allowed the employee to impact the lower surface, thus exposing the employee to a struck-by hazard.    ABATEMENT CERTIFICATION IS NOT REQUIRED
