29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or about July 19, 2012, at the above addressed jobsite, an employee performing carpentry operations from the roof was exposed to a fall, of nineteen (19) feet, created by the presence of unprotected sides.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. a. On or about July 19, 2012, at the above addressed jobsite, an employee performing carpentry operations from a tubular welded frame scaffold, fourteen (14) feet above the ground, was exposed to injuries from falls due to the lack of guardrails. LEVEL CONSTRUCTION INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(G)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313938607, CITATION NUMBER 1, ITEM NUMBER 1B AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 18, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 1724 PLAINFIELD ROAD, CREST HILL, IL 60435.
